GroundGuards Online Purchase Terms and Conditions

These terms apply to purchases made via the GroundGuards website (www.ground-guards.co.uk). Part A applies to consumers. Part B applies to business customers. For offline sales, please refer to our General Conditions of Sale.

Part A: Consumer Terms and Conditions

These Terms apply only to consumers purchasing through our website and not to business customers.

A1. About Us

  • GroundGuards is a trading name of Ground-Guards Limited (Company No. 08324672), registered at Rudgate, Walton, Leeds LS23 7AU.
  • You can contact us at info@ground-guards.co.uk or call 0113 267 6000.

A2. Our Products

  • Product images are for illustration only. Colours and packaging may vary.
  • Sizes, weights, and measurements shown on the site may have a tolerance of up to 2%.

A3. Use of Our Website

  • By using our website, you agree to our Website Terms of Use.
  • Your personal data is processed according to our Privacy and Cookies Policy.

A4. How Orders Are Formed

  • Our website guides you through placing an order.
  • You'll receive an order acknowledgment email, but your order is not accepted until we send a dispatch confirmation.
  • If an item is unavailable or priced incorrectly, we will inform you and may cancel or adjust the order.

A5. Your Right to Cancel

You have a legal right to cancel a contract under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013:

  • Single delivery: You have up to 14 days after you receive the goods to cancel your order.
  • Multiple deliveries: You can cancel your order within 14 days after the last item is delivered.
  • Scheduled delivery: You can cancel your order within 14 days after the first delivery.

A6. Returning Goods

  • Items must be returned within 14 days of cancellation to: Ground-Guards Ltd, Rudgate, Walton, Leeds LS23 7AU.
  • You must cover return postage unless the item is faulty or incorrect.
  • Returned goods must be unused and in resaleable condition. We may deduct from your refund if items are used or damaged.
  • Non-returnable items include custom-made products, opened hygiene items, or goods that are inseparably mixed with others.

A7. Refunds

  • Refunds will be processed within 14 days of receiving the goods (or evidence of return).
  • Refunds include original delivery cost (standard rate only).
  • Refunds will be made via the same payment method used at checkout.

A8. Delivery

  • We aim to dispatch within 30 days of order confirmation.
  • Delivery is complete once goods arrive at your address. All deliveries must be signed for.
  • If delivery is missed and not rearranged, we may cancel the order and deduct reasonable delivery and storage costs.

A9. International Delivery

  • You are responsible for customs duties, taxes and compliance with local laws.
  • We are not liable for customs delays or restrictions.

A10. Price and Payment

  • Prices include VAT unless stated otherwise. Delivery is charged separately.
  • We take care to display accurate prices. If we discover an error, we’ll contact you to confirm or cancel the order.
  • You can pay via credit card, debit card, or PayPal. We will only charge you once your order is dispatched.

A11. Our Responsibility to You

  • We are responsible for foreseeable loss or damage caused by us.
  • We are not responsible for business losses or unforeseeable issues.
  • We do not exclude liability for fraud, death, or personal injury caused by negligence, or breach of your statutory rights.

A12. Events Beyond Our Control

  • We are not liable for delays due to events outside our control (e.g. strikes, severe weather, transport issues).
  • If such an event continues for more than 30 days, you may cancel your contract and receive a refund.

A13. Legal Information

  • These terms are governed by English law.
  • You may bring legal proceedings in the courts of England and Wales, or (if you live there) in Scotland or Northern Ireland.

Part B: Online Business Purchase Terms

These terms apply to businesses purchasing via our website.

B1. Definitions

  • "Buyer": the business purchasing Goods
  • "Company": Ground-Guards Limited (trading as GroundGuards)
  • "Goods": the products listed for sale on our website

B2. Contract Formation

  • Your order is an offer. A contract is formed only when we confirm dispatch.
  • These terms override any terms submitted by the Buyer unless explicitly agreed in writing.

B3. Prices and Payment

  • Prices exclude VAT and delivery unless otherwise stated.
  • Payment must be made at checkout. Orders will not be dispatched without cleared payment.
  • If payment fails or is declined, the Company may cancel the order.

B4. Delivery

  • Delivery times are estimates. Time is not of the essence.
  • Delivery is complete when the goods are handed to the Buyer or their agent.
  • Risk passes on delivery.

B5. Returns and Restocking

  • Returns are accepted only with written approval.
  • Goods must be in resaleable condition. Returns may be subject to a 20% restocking fee.
  • Bespoke or modified goods are non-returnable.

B6. Title and Risk

  • Risk passes to the Buyer upon delivery.
  • Title remains with the Company until full payment is received.
  • If payment is not made, the Company may recover goods and access premises to do so.

B7. Warranty and Limitation of Liability

  • Goods are warranted to match the description on the site.
  • Faults must be reported within 14 working days of delivery.
  • Liability is limited to the value of the goods. The Company is not liable for indirect or consequential losses.

B8. Events Beyond Control

  • The Company is not responsible for delay or non-performance due to force majeure events such as natural disasters, strikes or supply chain disruptions.

B9. Governing Law

  • These terms are governed by English law. Disputes will be subject to the jurisdiction of the courts of England and Wales.
